This End User Licence Agreement (“EULA”) is between you and Medir Limited (“Licensor”) and applies to every mobile application published by Medir Limited (each, a “Licensed Application”). It supplements our Terms of Use. If an App is downloaded from the Apple App Store, this EULA also incorporates Apple's Licensed Application End User License Agreement where required.
Acknowledgement
You and Medir Limited acknowledge that this EULA is between you and Medir Limited only, and not with Apple Inc. (“Apple”) or Google LLC (“Google”). Medir Limited, not Apple or Google, is solely responsible for the Licensed Application and its content.
Scope of licence
We grant you a non‑transferable licence to use the Licensed Application on any Apple‑ or Android‑branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions or the Google Play Terms of Service. You may not distribute, rent, lease, lend, sell, sublicense or make the Licensed Application available over a network where multiple devices could use it at the same time.
Maintenance and support
Medir Limited is solely responsible for providing any maintenance and support for the Licensed Application, as described on our Support page or as required by applicable law. Apple and Google have no obligation to provide any maintenance or support services.
Warranty
Medir Limited is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application does not conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Licensed Application to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the Licensed Application.
Product claims
Medir Limited, not Apple, is responsible for addressing any claims by you or a third party relating to the Licensed Application, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy or similar legislation.
Intellectual property rights
If a third party claims that the Licensed Application, or your possession and use of it, infringes their intellectual property rights, Medir Limited, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third‑party terms
You must comply with applicable third‑party terms of agreement when using the Licensed Application, for example your wireless data service agreement.
Third‑party beneficiary
You and the Licensor acknowledge and agree that Apple and Apple's subsidiaries are third‑party beneficiaries of this EULA, and that, once you accept this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third‑party beneficiary.
Termination
This licence is effective until terminated by you or the Licensor. Your rights under this licence end automatically if you fail to comply with it. On termination, you must stop using and delete the Licensed Application.
